To successfully implement data governance, it is essential to have a clear vision and business case. A vision outlines your broad strategic objective for building a governance program, while a business case articulates the specific return on investment you expect to achieve. It will also define the roles, technologies and processes that will support your governance efforts.
Generally speaking, personal data in the Hong Kong Special Administrative Region is protected under the Personal Data Protection Policy (“PDPO”). The six Data Protection Principles (DPPs) of PDPO require that anyone who collects an individual’s personal data must comply with PDPO. This includes obtaining the prescribed consent of the individual for using their personal information. It is also required to inform the individual of what purpose the personal information will be used for and who it will be transferred to.
In some cases, there are exemptions from use limitations and access requirements. These include: (i) safeguarding of Hong Kong’s security, defence and international relations; crime prevention or detection; assessment, collection, or administration of any tax or duty; the prevention or deterrence of unlawful or serious improper conduct, dishonesty, or malpractice by persons; news activities; due diligence exercises; and life-threatening emergency situations.
The close tie between Hong Kong industries and Mainland business partners means that there is an increasing demand for cross-boundary services and data flow. To address this, the Innovation, Technology and Industry Bureau of the HKSAR Government has developed the Greater Bay Area Standard Contract to streamline the compliance arrangement in data flow for enterprises. This will further strengthen Hong Kong’s position as an innovation hub and promote the development of the GBA. In addition, it will complement national development and support the growth of the economy and research development in the GBA. Moreover, it will also ensure the privacy and security of the local population and businesses.
